Terms and Conditions

These Terms govern the use of the GUSTO platform and comply with Portuguese DL 7/2004 (E-Commerce Law), DL 24/2014 (Distance Contracts) and DL 446/85 (General Contract Terms).

1. Provider Identification

Ângelo Francisco Araújo da Cunha, independent professional, NIF 271 364 920, in Portugal. Activity under the simplified IRS regime (Category B), main activity: software development and related services.

2. Object

GUSTO provides a SaaS platform that lets restaurants manage menus, tables, orders, payments and reservations. End-customer orders and payments are made directly to the restaurant; GUSTO acts only as a technology facilitator.

3. Account and Access

  • The customer accesses the menu via QR code without registration.
  • The restaurant (Owner) registers and accepts these Terms when signing the commercial contract.
  • The Owner is responsible for the accuracy of prices, allergens and dish availability.

4. Pricing and Payment

All prices include VAT at the rate in force. Payment is processed by a certified gateway (Stripe, Easypay or MBWay). GUSTO has no access to card data.

5. Right of Withdrawal

Under Article 17 of PT DL 24/2014, consumers have 14 days to withdraw from distance contracts except for perishable goods (Art. 17/1/d): prepared meals are excluded once preparation has begun.

6. Complaints

You may file a complaint via the Portuguese Electronic Complaints Book at livroreclamacoes.pt or via the EU Online Dispute Resolution platform at ec.europa.eu/odr.

7. Liability

GUSTO is not liable for:

  • Meal quality (the restaurant's responsibility).
  • Delivery time compliance — estimates only.
  • Service interruptions due to force majeure, scheduled maintenance, or third-party failures (Mongo Atlas, Stripe, etc.).

8. Intellectual Property

All software, logos, layouts and texts are GUSTO's property. Reproduction without written authorisation is prohibited.

9. Governing Law and Jurisdiction

These Terms are governed by Portuguese law. The District Court of Lisbon has exclusive jurisdiction over any dispute, waiving any other forum.
